TERMS & CONDITIONS

The following paragraphs contain the general terms and conditions under which College Storage & Student Services (CS&SS) is engaged in the movement, transportation and/or storage of personal items including, but not limited to, appliances, boxes and packages within the United States or internationally and jointly through interchange with its partner companies. CS&SS reserves the right to amend any portion of this service explanation at any time. Terms for the shipment of goods via our preferred shipper, United Parcel Services (UPS®), can be found at www.ups.com.

Other product and company names mentioned herein may be the trademarks of their respective owners. Any rights not expressly granted herein are reserved to CS&SS.

OWNERSHIP OF PROPERTY:

The consumer, herein called “Customer” has represented and warranted to CS&SS that he or she is the legal owner or in lawful possession of the property and has the legal right and authority to contract for services of all of the property tendered, upon provisions, limitations, terms and conditions herein set forth and that there are no existing liens, mortgages or encumbrances on said property. If there be any litigation as a result of the breach of this clause the Customer agrees to pay all charges that may be due together with such costs and expenses including attorneys fees which CS&SS may reasonably incur or become liable to pay in connection therewith and CS&SS shall have a lien on said property for all charges that may be due them as well as for such costs and expenses.

STORAGE SERVICES:

Storage Services shall include the pickup, transportation, storage, and delivery of the Customer's possessions. The Customer shall present pre-packed personal goods to the CS&SS at the time of pickup. CS&SS shall transport these goods to a climate controlled storage facility chosen at the sole discretion of CS&SS. CS&SS will return the goods to the Customer during dates and times established by CS&SS by considering school and dormitory schedules. Customer agrees to be present to receive the goods at the specified delivery date, time, and location.

The Customer understands access to goods in storage is permitted only with 7 business days prior notice and upon payment of a non-refundable fee as per the Pricing schedule below. If the items must be delivered prior to the specified delivery dates, an additional $95 fee will apply. Customers have the option to purchase access coverage ($35) for up to one visit to the storage facility. Purchase for access coverage must be made at the time the Customer pays for CS&SS services. Additional visits by the Customer will require a payment of $20 per visit.

Changes to the previously scheduled delivery date or location must be communicated by the Customer in writing to CS&SS at least 10 business days prior to the earlier of the originally scheduled delivery date and the new delivery date. Changes made within 10 business days of delivery are not guaranteed. An additional fee may be assessed as per the Pricing schedule below. Customer agrees to pay a non-refundable deposit fee in the amount of $35 to reserve a storage space. Payment in full is required at the time the Customer registers for services. The Customer agrees to pay in full within 30 days of billing date for additional service charges incurred. Unpaid balances that exceed 30 days will incur a $10 late fee.

Short Term Summer Storage

Delivery date for short term storage will take place on the next business and exclude major holidays. Hours of delivery are 9 a.m. – 4 p.m., Monday – Friday. If a weekend delivery is required Customer agrees to pay a weekend delivery fee of $35. If early delivery of items is required by Customer, Customer agrees to pay for storage plan minimums and shall not receive a refund, proration for unused day(s) or any other credit or compensation. Customer shall select a delivery window time of 2 hours during delivery hours and be present or designate someone to be present to receive delivery. Customer agrees to pay $7 per box, per day for items that are stored longer than allotted plan time.

Off-campus delivery will be available for locations within a 4 mile radius of campus. Delivery locations outside of 4 mile radius will result in a $50 fee.

30 Day Storage

The $1 dollar per day, per box rate is for a minimum of 30 Days of storage and for CS&SS boxes purchased by Customer or a maximum box size of 4.5 cubic feet. Stored items that are larger then 4.5 cu ft and less than 5.5 cubic feet will be stored at a rate of $1.50 per box per day. Items exceeding 5.5 cubic feet will be stored at a rate of $2 per box per day. CS&SS will deliver items on the 30th day from the pick-up date. Early delivery and weekend delivery fees will apply as stated in above paragraph.

14 Day Storage

14 Day Storage Plan rates is for CS&SS boxes purchased by Customer or a maximum box size of 4.5 cubic feet. CS&SS boxes are stored at a rate of $35 per box with a 4 minimum for 14 days. Stored items that are larger then 4.5 cu ft and less than 5.5 cubic feet will be stored at a rate of $40 per box with a 4 box minimum for 14 days. Items exceeding 5.5 cubic feet will be stored at a rate of $45 per box with a 3 box minimum for 14 days. Customer agrees to store items for a minimum of 30 days. Delivery will take place on the 14th day from the pick-up date. Early delivery and weekend delivery fees will apply as stated in above paragraph.


SHIPPING SERVICES:

CS&SS shall act only as an intermediary for the receipt and forwarding of the Customer's shipping items to CS&SS-preferred shipping carrier (UPS®). The Customer agrees to complete a Shipping Order (SO) provided by CS&SS in a legible and complete manner prior to pickup of the goods by CS&SS. CS&SS will pickup and transport the shipping items to UPS. UPS will deliver the items to the address specified on the shipping labels after processing their pickup. UPS will be used for all shipments. UPS Ground is the preferred level of service that will be used unless the Customer specifically requests and pays for UPS Next Day Air®, Next Day Air Saver®, 2nd Day Air® or 3 Day Select® or International service.
CS&SS has the discretion to accept or reject the Customer’s items being shipped. CS&SS is not responsible for any loss or damage to the Customer’s items if such loss or damage occurred during transport by UPS. It is the Customer’s responsibility to file a claim with UPS for damaged or lost items. Customer agrees not to ship items that are designated unacceptable by UPS. A list of these items may be obtained by contacting UPS.com.

CS&SS must receive shipped items within 5 days of the scheduled delivery date for items that will be shipped from the Customer’s home to the Customer’s school. Any items that are not received by CS&SS prior to the 5th day preceding the delivery date may be subject to additional shipping charges as set forth in the Pricing Schedule. It is the Customer’s responsibility to ensure that items are shipped to meet this deadline.

At its discretion, CS&SS may file and process a claim on the customer’s behalf for delayed shipping deliveries if applicable or damage or lost packages. This applies only to domestic shipments within the continental United States. The Customer further agrees they will maintain a copy of their tracking number provided by the shipper and all documentation related to the shipment. Tracking numbers are not the responsibility of CS&SS.

BACK TO SCHOOL SERVICES:

CS&SS shall receive in its selected warehouse packages shipped by the Customer using the CS&SS back to school shipping service or any other shipping service. CS&SS has the right to inspect incoming packages for damage to the exterior packaging only. CS&SS will not be responsible for any damages sustained during shipping to the warehouse. Customers must obtain “declared value” protection from UPS for their shipped items.

PICK UP & DELIVERY:

CS&SS establishes pick up and delivery dates and times. The schedule will be communicated directly to the Customer at time of sign up. CS&SS reserves the right to reschedule such times without prior notice to the Customer. The Customer recognizes that CS&SS will not be held liable for damage to their belongings after delivery has occurred. In the event that the Customer is not present during their scheduled delivery date and time, CS&SS designated representatives will leave their belongings outside their room and CS&SS liability for the Customer's belongings will cease. If absent during delivery, the signature of the CS&SS designated representative making the delivery will evidence the delivery of the Customer's items in good condition. A rescheduled or missed pick-up will result in additional fees as described in the fees schedule. Further, in the event that Customer is unable to be present during the Pick-up Window or if the pick - up location changes, the Customer must provide notice to CS&SS one business day prior to the Scheduled Pick-up Date. Failure to provide timely notice will result in a charge to Customer of CS&SS’ prevailing fee of $40 for pick-ups outside of the Scheduled Pick-up date.

The Customer recognizes that only loss or damage caused by the negligence of CS&SS will be covered by the CS&SS declared value policy, as described in these Terms and Conditions. Only physical damage to the exterior of the item will activate any insurance claim on the item.

If a Customer's items are improperly packed and the Customer would still like to store those items, CS&SS will pack or re-pack the Customer's items, and Customer shall pay an additional fee at CS&SS' prevailing hourly service rate ($19.95), as such hourly service rate is set forth on the CS&SS Website. This fee will not include any packing materials used. Packing materials will be charged separately, according to CS&SS’ prevailing packing material fees, as such additional fees are set forth on the CS&SS Website.

Additional fees and charges will be assessed if the Customer does not live within a four (4) mile radius of the main campus at the school. CS&SS will assess such fees and charges based on the distance from the main campus and the time it takes to travel to such location, according to CS&SS’ prevailing standard rates for delivery and travel. In any event and in addition to any other applicable fees and charges, a minimum fee of $50.00 will be charged for any pick - up or drop - off that is not within a four (4) mile radius of the school's main campus.

DISCLOSED ITEMS:

Disclosed Item Sheet (DISh) will be used for declared value purposes only. CS&SS will provide the Customer with DISh for each pick up. The DISh’s must be completed before CS&SS takes possession of any goods owned by the Customer. The Customer hereby states that all information provided on the DISh is accurate. CS&SS is not responsible for any items not listed on the DISh. The Customer agrees to complete the DIShs for all storage and shipping items. CS&SS does not consent to the accuracy of any DISh filled in by the Customer. The Customer agrees not to store or ship coins, cash, food, biohazard material, any items declared hazardous, illegal, toxic or flammable by CS&SS or UPS (visit UPS.com for a complete list).


CS&SS SERVICE GUARANTEE

Concerning the Customer's shipping items, CS&SS assumes no liability for the failure to make any specified delivery time or for the successful completion of delivery of the items or the contents thereof.

CS&SS guarantees on-schedule pickup of shipping and storage items and delivery of storage items. CS&SS will provide the Customer with a maximum window of four (4) hours during which pickup or delivery will occur. In the event CS&SS fails to arrive to pickup or deliver the Customer's goods during the specified time window, CS&SS will issue a credit equal to 10% of the total price of the Customer's order (excluding taxes), subject to the conditions below:

a. The Customer was present in their residence throughout the applicable four-
hour window.
b. In the case of pickup, the customer has all packages packed, labeled, and prepared
for pickup prior to CS&SS arrival.
c. In the case of the delivery of stored goods, the Customer has correctly labeled
each of their packages with their name
d. CS&SS is notified in writing or by telephone of a service failure within seven (7)
calendar days from the date of the scheduled pickup or delivery.


COMMODITIES HANDLED & RESTRICTIONS

The guarantee does not apply if the failure to perform within the pickup or delivery window is due to causes beyond CS&SS' control including, but not limited to, the following: the unavailability or refusal of a person to accept delivery of the stored items; acts of nature; public authorities acting with actual or apparent authority on the premises; acts or omissions of police or similar authorities; riots, strikes, or other labor disputes; civil commotions; disruptions in ground transportation networks, such as weather phenomena; and natural disasters. Since CS&SS will act as an intermediary for our Shipping Carrier, the Customer must be advised that our Carrier holds itself out to transport general commodities, as usually defined, subject to the restrictions that are available at their Web site. The Customer agrees to familiarize themselves with the Carrier's restrictions prior to packing their articles for shipping.

CS&SS provides storage services subject to a number of restrictions. The Customer accepts full responsibility and liability for any damages or losses that result from the Customer's failure to adhere to these service restrictions. No storage service shall be rendered:

a. In the case of articles of unusual value, or of single packages having a value of more than $100 (U.S), or of collective packages having a value of more than $600 (U.S.) plus $100 (U.S.) per package.
b. For items containing valuables such as jewelry, collectibles and currency.
c.
For hazardous materials and firearms.
d. For any items that are prohibited by law or regulations of any federal, state, provincial, or local government in the U.S.
e. For the transportation and storage of articles prohibited by CS&SS’ logistics vendors

CS&SS will not store or ship packages containing liquids, and the Customer acknowledges that they are liable for any damage their storage contents may inflict on the property of others.
CS&SS reserves the right to refuse any package which by reason of the dangerous or other character of its contents is liable, in the judgment of CS&SS, to soil, taint, or otherwise damage other merchandise or equipment, or which is economically or operationally impractical to transport, or which is improperly packed or wrapped. CS&SS reserves the right to open and inspect any package tendered to it for storage or shipping.

INSURANCE:

CS&SS automatically protects each CS&SS storage and shipping package against loss or damage up to a value of $100. Unless the Customer purchases insurance from collegestudentinsurance.com, the Customer agrees that the released value of each package is no greater than $100 and that CS&SS liability is limited to $100. To the extent that the Customer does not obtain additional insurance coverage for the full value of their personal property stored or shipped with CS&SS, the Customer hereby agrees to assume all risk of loss, including damage or loss by burglary, fire, vandalism or vermin, acts of nature or terrorism. CS&SS and CS&SS agents, affiliates, authorized representatives and employees will not be responsible for, and the Customer hereby releases from, any loss, liability, claim, expense, damage to property or injury to persons that could have been insured (including without limitation any loss arising from the active or passive acts, omission or negligence of CS&SS or its agents, affiliates, authorized representatives and employees).

Where the replacement value of the Customer's possessions exceeds $100 per package CS&SS recommends the purchase of additional insurance. Additional insurance is available at www.collegestudentinsurance.com.

The Customer releases CS&SS of any liability for damage to items with a carton, trunk or other casing without physical damage to the exterior. The Customer is liable for any damage their stored items may inflict on the property of others. All coverage is limited to the dates when CS&SS has possession of the Customer’s items. A surcharge will be applied to customer’s bill for items not shipped in a box.

ABANDONMENT

Without limiting the right of CS&SS to conclude for other reasons that the Customer will not be returning to school, the Customer agrees that their failure to be present on the scheduled delivery day and their failure to communicate with CS&SS concerning an alternate delivery arrangement constitutes abandonment of their stored possessions.

Under abandonment of their possessions, the Customer agrees to pay CS&SS for all charges and fees relating to the failed delivery and further shipping of the possessions to the permanent address provided by the Customer at the time of registration. If not claimed or delivered within 60 days of the first day classes begin, CS&SS has the right to assume ownership of the abandoned property on December 30th of the service year. Excludes CS&SS web site registered study abroad program students.

PACKING MATERIALS DELIVERY

CS&SS will make available packing materials one week prior to the move out week. CS&SS will notify the Customer in advance of the dates, times and locations where materials can be picked up. It is the Customer responsibility to make arrangements to acquire packing materials during the dates, times and locations specified.

Storage boxes used by the customer that are not CS&SS storage boxes will be charged at a separate rate based on CS&SS box. The rate will be based on the nonconforming box largest dimension or cubic feet, which ever is greater. Boxes weighing over 50 lbs. will be charged a 40% surcharge at the sole discretion of CS&SS.

LIABILITY

YOU HAVE FULL RESPONSIBILITY FOR, AND BEAR ALL RISK OF LOSS OR DAMAGE TO THE BOXES AND THEIR CONTENTS, AND FOR ANY DAMAGE CAUSED TO YOUR PROPERTY OR TO THE PROPERTY OF OTHERS BY THE BOXES OR BY THEIR CONTENTS WHILE THE BOXES REMAIN IN YOUR POSSESSION, INCLUDING WHILE THE BOXES ARE ON YOUR DRIVEWAY OR LOADING DOCK, OR IN ANY HALLWAY OR ANY OTHER COMMON AREA OF YOUR RESIDENCE.
SUBJECT TO THE SECTION ENTITLED INSURANCE, FOLLOWING PICK-UP OF YOUR BOXES FROM YOUR RESIDENCE UNTIL THE BOXES ARE DELIVERED TO YOU, CS&SS DOES NOT ASSUME ANY RISK FOR LOSS OR DAMAGE TO THE PERSONAL PROPERTY YOU HAVE PLACED IN THE BOXES FOR STORAGE, NO MATTER HOW THE LOSS OR DAMAGE MAY BE CAUSED, EXCEPT FOR LOSS OR DAMAGE CAUSED DIRECTLY BY OUR GROSS NEGLIEGNCE OR WILLFUL MISCONDUCT, AND IN ANY EVENT CS&SS' AGGREGATE MAXIMUM LIABILITY TO YOU SHALL NOT EXCEED THE FEES YOU PAID FOR THE SERVICES.

Customer shall defend, indemnify and hold harmless CS&SS and its employees, agents and representatives from and against any and all claims, actions, demands, liabilities, damages, costs and expenses.

PAYMENT

Customer agrees to provide a credit card at the time of pick up or prior to pick up. The Customer agrees to pay the total cost of the Services provided by CS&SS as indicated on the Online Order Form, hard copy Sign-Up Order Form and Customer Agreement, plus applicable taxes, in accordance with the payment terms set forth on the Order Form and Customer Agreement. Pricing can be found on the CS&SS Website, in the Pricing Section. The Customer further agrees to pay any applicable fees and charges as specified in this Agreement or on the CS&SS Website, which fees and charges are subject to change at any time. Customer acknowledges that there shall be no refunds or credits provided to Customer, except as expressly set forth in this Agreement.

Customer must pay the total cost of the Services at the time of Pick-up.

If the Customer pays by credit card, the Customer hereby authorizes CS&SS to charge Customer's credit card within two (2) weeks of the pick-up date. In the event that a Customer's payment cannot be authorized all charges associated with this Agreement must be paid in full in order to receive your items before the time of their delivery, plus any applicable late fees or other applicable fees and charges.

If Customer fails to pay any amount within thirty (30) days after it is due, the Customer's possessions shall be deemed abandoned, and CS&SS shall have the right, but not the obligation, to take any reasonable action to dispose of any abandoned property, to recover any outstanding balance from the Customer. Customer shall be responsible for any costs incurred by CS&SS in connection with disposal of Customer's property. CS&SS will have no obligation whatsoever to disclose information concerning action taken if any, and may still take necessary legal measures to obtain payment for Services provided from the Customer. CS&SS shall have no obligation to return any proceeds from the disposal of the Customer's property, and any proceeds in excess of the outstanding balance owed to CS&SS under this Agreement shall be retained by CS&SS as liquidated damages.

APPLICABLE LAW

This Agreement shall be governed by the laws of the State of California, without regards for conflicts of law.
